Ah, but you see it specifically says to 'preserve, protect, and defend' which could be interpreted as perpetuate the existence of the constitution, not necessarily execute the laws enumerated by the constitution. To that point, the oath doesn't distinguish between the constitution: paper document and the constitution: the law. So really, legally, he's upholding his oath. Maliciously.

Oath clearly refers to the physical document. Doesn't say a thing about the words scribbled on it. That's why he's got it framed in the oval office: so he can keep close eye on it and make sure no one crumples it up.
