Since we are not on Reddit and out of the tentacles of DMCA, can we freely paste safe-to-share pirated links without any obfuscation and hints?

You can share as long as you keep one degree of separation. Prefer base64 links

I don't think we're technically out of DMCA. Instance owners are still responsible for the content on their servers (if they receive a DMCA takedown request), at least in the US.

To not scare any other instances from defederalization and for the piracy to reach as broadly as it can, we need to be within all "legal" limits. The subreddit survived for so long (and is now desired by reddit themselves? Lol) because our incredible mods kept it so. So let's continue with that trend here. Rule 3 also makes us all better pirates in the long run.

Make base64 code and it should be fine, I think the maker of this instance said magnet links are fine too and general looks to websites just not directly to the content as in fit girls page would be fine just not anything on it.

But I bet they will comment at some point

DMCA is a legal thing, not a reddit thing. so it still applies. iirc the rule here is 1 degree of separation or obfuscated links.

Not sure why you would think this place is out of reach of DMCA.

The most probably it is just make sure to use a VPN for extra protection ✌️👍.

Instance runners and mods can take down the content to avoid any legal issues in the case there is any anyway but they could not be able to identify where you physically at.

Client side is much simpler as we can easily mask ourselves (e.g. with VPN, tor, ssh tunnel, etc).

What about server-side? They are much more exposed as they cannot just move around like clients.

I believe the only way would be hosting on a very very permissive country. New Zealand or something.

Unless server admin set up a VPN on the instance server and swipe location every week or something.

You did mentioned Sweden & Switzerland. Are they one of those permissive countries? Not familiar with the legalities & jurisdiction myself.

Is it possible to mask the server's real location by putting VPN between the server and the domain name? The domain name would still be a sitting duck, tho, wouldn't it?

Sweden and Switzerland are very very permissive countries about what people do online, and about the domain name maybe running you own DNS but I'm not sure.

If the instance is running in a country that doesn't honor DMCA takedowns then yeah it would be totally in the clear. I don't know if this one is or isn't, but the technology allows for it.

Even then it isn't a good idea. Any instance that is federated and has users of this sub would also be hosting the links and is required to respond to DMCA. The only thing that direct link sharing would lead to is the defederation of this instance.

Seems that dbzer.com is hosted in Germany. I don't know how that impacts any DMCA takedown requests though after a quick search. It might depend more on the hosting company the dbzer admin is using and their logging and DMCA compliance policies. So in short, probably better to be safe than sorry (I.E. get the admin in trouble) Obfuscate links at the very least.
